I am at total ah, that there is nothing we can do when we are getting ripped off for our hard earn money.I was in need of money fast i did not want to go thru a payday loan cause the charges are ridiculous, so i went and did a google search for loans with people with bad credit, I went to a website www.weapproveeveryone.com It says the name of the business is FINANCIAL BENEFITS i put in my application and it stated someone would contact me shortly. The next day 2-1-07 I receive a call from Susan Moore stating she is with Financnial Benefits and I have been approved for a $5000.00 loan at 6 % interest and my monthly payment would be $165.00 then she stated i would have to send 525.00 via moneygram to Mark Clark in Canada which I did i called susan to give her the pin she stated i would receive call from lender telling me where i can pick my money up, i still have not heard from anyone. HELP me the agency’s say i will never get my $ back and they have lots of cases its time for payback!

Is a returned ACH Transfer the same as writing a bad check? Can one be criminally prosecuted?

I got a payday loan online through nationalpayday.com. I already read the law for Indiana where i live and it explicitly prohibits any criminal action being taken for not repaying a loan. However, I would like to know, in any case, Is a returned ACH transaction the same as writing a bad paper check? IE if your ACH payment on a cell phone or car bounces can they take you to court and prosecute you the same as if you wrote a bad check?

I have been battling a fight thanks to my ex husband who has skipped town. He took out several online payday loans in my name before our divorce and since I change bank accounts it automatically stop the ach debits for these loans that I didn’t know about. He handled our of finances. Well, I received a call from some firm in Houston Texas (supposedly). I can’t understand the representative on the phone hardly. But the phone number comes up from an area around Houston TX. They are threatening misdemeanor charges due to a bad ACH on the loan? Can they do that?
